Ratification of Proclamation 2018 Deadline Extension for Publisher affected by
Hurricane Harvey

SUMMARY:
The State Board of Education (SBOE) issued Proclamation 2018 in November 2016. This item gives the board the opportunity to ratify a deadline extension for Kendall Hunt, a publisher that was unable to meet the published deadline due to flooding as a result of Hurricane Harvey. The published deadline to provide the Publisher’s Identification of Factual Errors and Editorial Changes was September 8, 2017. The board chair gave tentative approval to extend it to September 22, 2017.

STATUTORY AUTHORITY:
Texas Education Code (TEC), §31.022.

TEC, §31.022, which requires the SBOE to adopt rules to provide for a full and complete investigation of instructional materials for each subject in the foundation curriculum and for each subject in the enrichment curriculum.

PREVIOUS BOARD ACTION: The SBOE called for instructional materials in Special Topics in Social Studies in Proclamation 2017, which was issued in April 2015 and amended in April 2016. The board did not adopt social studies materials submitted in response to that call. The board issued Proclamation 2018 calling for Special Topics in Social Studies materials in November 2016.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: This item gives the board the opportunity to ratify a deadline extension for Kendall Hunt, a publisher that was unable to meet the published deadline due to flooding as a result of Hurricane Harvey. The published deadline to provide the Publisher’s Identification of Factual Errors and Editorial Changes was September 8, 2017. The board chair gave tentative approval to extend it to September 22, 2017. Board members were notified at the September 2017 meeting that the deadline had been extended and that an action item would be presented at the November meeting.

FISCAL IMPACT: None.

PROCEDURAL AND REPORTING IMPLICATIONS: None.

PUBLIC COMMENTS: None.

OTHER COMMENTS AND RELATED ISSUES: Approval of the report from the commissioner regarding instructional materials offered for adoption under Proclamation 2018 is presented as a separate action item in this agenda.
