Review of Proposed Revisions to 19 TAC Chapter 231, Requirements for Public School Personnel Assignments, Subchapter C, Grades 6-8 Assignments, and Subchapter E, Grades 9-12 Assignments

SUMMARY:
This item provides the State Board of Education (SBOE) an opportunity to review State Board for Educator Certification (SBEC) rule actions that would amend 19 TAC Chapter 231, Requirements for Public School Personnel Assignments, Subchapter C, Grades 6-8 Assignments, and Subchapter E, Grades 9-12 Assignments, that would incorporate career and technical education (CTE) courses approved by the SBOE. The proposed revisions would also incorporate requirements to complete Texas Education Agency (TEA)-approved training or appropriate training in state and federal requirements regarding work-based learning and safety and add certificate areas to the list of credentials appropriate for placement into a particular assignment.

STATUTORY AUTHORITY: The statutory authority for 19 TAC Chapter 231, Subchapters C and E, is the Texas Education Code (TEC), §§21.003(a), 21.031(a), and 21.041(b)(1) and (2).

TEC, §21.003(a), states that a person may not be employed as a teacher, teacher intern or teacher trainee, librarian, educational aide, administrator, educational diagnostician, or school counselor by a school district unless the person holds an appropriate certificate or permit issued as provided by the TEC, Chapter 21, Subchapter B.

TEC, §21.031(a), states that the SBEC shall regulate and oversee all aspects of the certification, continuing education, and standards of conduct of public school educators.

TEC, §21.041(b)(1), requires the SBEC to propose rules that provide for the regulation of educators and the general administration of the TEC, Chapter 21, Subchapter B, in a manner consistent with the TEC, Chapter 21, Subchapter B.

TEC, §21.041(b)(2), requires the SBEC to propose rules that specify the classes of educator certificates to be issued, including emergency certificates.

EFFECTIVE DATE: The proposed effective date of the proposed revisions to 19 TAC Chapter 231 would be December 17, 2017.

PREVIOUS BOARD ACTION:
None.

BACKGROUND INFORMATION AND JUSTIFICATION: Current 19 TAC Chapter 231, Requirements for Public School Personnel Assignments, provides guidance to school districts by listing courses by grade level and subject area and identifying the corresponding certificates appropriate for placement into each classroom assignment. This information assists districts with hiring and personnel assignment decisions.

The proposed revisions to 19 TAC Chapter 231, Subchapter C and Subchapter E, would identify and align the appropriate SBEC-issued certificates to each assignment and are based on the following: course curriculum; the information that must be transferred from teachers to students to ensure successful progressions from one grade level to the next; and the critical need to maintain alignment with SBOE-approved courses and comply with state and federal requirements. This cyclical work provides school districts with the most current guidance and best practices for ensuring that every individual has the appropriate certificate and meets any other requirements necessary prior to being placed into a particular assignment.

To reflect career and technical education courses approved by the SBOE, the proposed revisions to 19 TAC Chapter 231, Subchapter C and Subchapter E, shown in Attachment II, are outlined below.

Attachment II also reflects changes the SBEC made at adoption at the October 6, 2017 meeting to extend the implementation date for training to the 2019-2020 school year, which would allow TEA staff to develop more robust training. The sections that reflect the extended implementation date are: §§231.271(d), 231.283(b), 231.287(b), 231.365(b), 231.394(b), 231.395(b), 231.397(b), 231.423(b), 231.425(b), 231.445(b), 231.503(b), 231.525(b), 231.565(b), 231.569(b), 231.573(b), 231.575(b), 231.577(b), 231.579(b), and 231.581(b).

Subchapter C. Grades 6-8 Assignments

§231.79. Career Development, Grades 6-8

The proposed amendment would reflect new course names. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

Subchapter E. Grades 9-12 Assignments

Division 9. Career Development, Grades 9-12 Assignments

§231.271. Career Development, Grades 9-12

The proposed amendments in subsections (a) and (b) would reflect new course names. The proposed amendment in subsection (c) would add a new course and identify certificates appropriate for placement into the assignment. The proposed amendment in subsection (d) would identify the training requirement prior to placement into the assignment. The proposed amendment in subsection (e) would reflect new course names. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments. The implementation date to complete TEA-approved training has been extended to the 2019-2020 school year to allow time to develop robust training for this course. The reference to completion of training in state and federal requirements regarding work-based learning and safety ensures the teacher can establish and maintain a safe learning environment for all students.

Division 10. Agriculture, Food, and Natural Resources, Grades 9-12 Assignments

The proposed amendment in subsection (a) would reflect new course names. The proposed amendment in subsections (b) and (c) would add additional course names. §231.283. Advanced Animal Science and Advanced Plant and Soil Science, Grades 9-12

The proposed amendment in subsection (b) would identify the training requirement prior to placement into the assignment. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments. The implementation date to complete TEA-approved training has been extended to the 2019-2020 school year to allow time to develop robust training for this course.

§231.287. Mathematical Applications in Agriculture, Food, and Natural Resources, Grades 9-12

§231.289. Agricultural Equipment Design and Fabrication; Agricultural Structures Design and Fabrication; Agricultural Mechanics and Metal Technologies; Agricultural Power Systems; Oil and Gas Production, Grades 9-12

The proposed amendment to paragraphs (4)-(6) would reflect new course names and eliminate certificates no longer appropriate for placement into the assignment. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

§231.291. Floral Design, Grades 9-12

The proposed amendment to paragraphs (3)-(6) would reflect new course names and eliminate certificates no longer appropriate for placement into the assignment. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

Division 11. Architecture and Construction, Grades 9-12 Assignments

§231.301. Principles of Architecture; Principles of Construction, Grades 9-12

The proposed amendment would reflect the new course name. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

§231.303. Interior Design, Grades 9-12

In response to public comment, at the October 6, 2017 SBEC meeting, the board modified at adoption, subject to SBOE review, subsections (a), (b), and (c) to reflect the new course name and to expand the list of certificates appropriate for placement into the assignment. Teachers with recent work experience in the interior design industry and a certification in the field are qualified to teach the sequence of interior design courses. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

§231.305. Architectural Design, Grades 9-12

The proposed amendment in subsection (a) would reflect the new course name, and the proposed amendments in subsections (b) and (c) would add new courses. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

§231.307. Construction Management; Construction Technology, Grades 9-12

The proposed amendment in subsection (a) would reflect the new course name, and the proposed amendments in subsections (b) and (c) would add new courses. §231.309. Building Maintenance Technology, Grades 9-12

§231.313. Electrical Technology; Heating, Ventilation, and Air Conditioning (HVAC) and Refrigeration Technology; Masonry Technology; and Plumbing Technology, Grades 9-12

The proposed amendment would update the course titles. The proposed amendment in subsection (a) would reflect the new course names. The proposed amendment in subsection (b) would reflect the new course names and identify certificates appropriate for placement into the assignment. The proposed amendment in subsection (c) would identify state and federal training requirements prior to placement into the assignment. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments. The reference to completion of training in state and federal requirements regarding work-based learning and safety ensures the teacher can establish and maintain a safe learning environment for all students.

The proposed amendment to paragraphs (2)-(5) would remove the degree requirement and semester credit hour references. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with appropriate credentials into classroom assignments.

§231.333. Principles of Arts, Audio/Video Technology, and Communications, Grades 9-12

§231.335. Animation, Grades 9-12

The proposed amendment in subsection (a) would reflect the new course names. §231.339. Photography, Grades 9-12

In response to public comment, at the October 6, 2017 SBEC meeting, the board modified at adoption, subject to SBOE review, subsections (a) and (b) to broaden credentials appropriate for placement into the assignment and delete the previous list of certificates specified in rule.

Division 15. Finance, Grades 9-12 Assignments

§231.393. Accounting I; Financial Analysis; Insurance Operations; and Securities and Investments, Grades 9-12

§231.591. Transportation, Distribution, and Logistics, Grades 9-12

The proposed amendment to subsection (a) would add courses, delete courses, and eliminate certificates no longer appropriate for placement into the assignment. The proposed amendment to subsection (b) would add courses and eliminate certificates no longer appropriate for placement into the assignment. The proposed amendment to subsection (c) would add courses and identify the state and federal training requirement prior to placement into the assignment. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments. The reference to completion of training in state and federal requirements regarding work-based learning and safety ensures the teacher can establish and maintain a safe learning environment for all students.

At the October 6, 2017 SBEC meeting, the board modified at adoption, subject to SBOE review, subsection (a) to include technical edits to accurately reflect the course titles.

§231.593. Aircraft Technology, Automotive Technology, or Collision Repair and Refinishing, Grades
9-12


The proposed repeal of this section would delete the course title and related information. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments. The courses previously listed in this section proposed for repeal and the certificates appropriate to teach the courses have been incorporated into §231.591, Transportation, Distribution, and Logistics, Grades 9-12.

§231.595. Small Engine Technology, Grades 9-12

The proposed amendment would add and delete courses. This rule change aligns with the titles of CTE courses approved by the SBOE and provides clarity for district personnel using these rules to place educators with the appropriate credentials into classroom assignments.

SBOE Review of Proposed SBEC Rules

Under the TEC, §21.042, the SBEC must submit a written copy of each rule it proposes to adopt to the SBOE for review. The SBOE may reject the proposed rule by a vote of at least two-thirds of the members of the SBOE present and voting, but may not modify a rule.

FISCAL IMPACT:
The TEA staff has determined that there is no additional fiscal impact on state and local governments and there are no additional costs to persons or entities required to comply with the proposed rule actions. In addition, there is no direct adverse economic impact for small businesses, microbusinesses, and rural communities; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required. There is no effect on local economy; therefore, no local employment impact statement is required under Texas Government Code, §2001.022. The proposed revisions do not impose a cost on regulated persons and, therefore, are not subject to Texas Government Code, §2001.0045.

PUBLIC AND STUDENT BENEFIT:
The public and student benefit anticipated as a result of the proposed revisions would be the ability of districts to continue placing educators who are prepared to positively affect the performance of the diverse student population of this state into career and technical education assignments. There are no anticipated additional costs to licensees or other regulated persons.

PROCEDURAL AND REPORTING IMPLICATIONS:
The proposed amendments would have no additional procedural and reporting implications.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed amendments would have no additional locally maintained paperwork requirements.

PUBLIC COMMENTS: In accordance with the SBEC rulemaking process, a summary of comments received by the SBEC on its proposed rules is shared with the SBOE under separate cover prior to this SBOE meeting.

OTHER COMMENTS AND RELATED ISSUES: None.

MOTION TO BE CONSIDERED: The State Board of Education:
