3. Action on Earlier Effective Date of Adopted Amendment to 19 TAC §33.65, Bond Guarantee Program for School Districts 

This item provides the opportunity for the State Board of Education (SBOE) to consider action to approve an earlier effective date for the amendment to 19 TAC Chapter 33, Statement of Investment Objectives, Policies, and Guidelines of the Texas Permanent School Fund, Subchapter A, State Board of Education Rules, §33.65, Bond Guarantee Program for School Districts, adopted at the September 2015 SBOE meeting. At its September 2015 meeting, the SBOE voted to approve the amendment but did not approve an earlier effective date. Pursuant to the Texas Education Code (TEC), §7.102(f), the adopted rule would have an effective date of the beginning of the 2016-2017 school year, unless the board approves by a two-thirds vote an earlier effective date. The statutory authority for the proposed action on an earlier effective date is TEC, §7.102(f).

4. Review of Proposed Amendment to 19 TAC Chapter 242, Superintendent Certificate, §242.20, Requirements for the Issuance of the Standard Superintendent Certificate  

This item provides the State Board of Education (SBOE) an opportunity to review the State Board for Educator Certification (SBEC) rule action that would amend 19 TAC Chapter 242, Superintendent Certificate, §242.20, Requirements for the Issuance of the Standard Superintendent Certificate. The proposed amendment to 19 TAC §242.20 would provide an individual seeking a superintendent certificate the option to substitute managerial experience in a public school district for the requirement of a principal certificate. Additionally, the amendment would allow a candidate to obtain standard certification as a superintendent provided that the candidate is hired by a public school district in Texas, successfully completes an SBEC-approved superintendent preparation program, satisfactorily completes the certification examination for superintendents, and holds a post-baccalaureate degree. The proposed amendment would also require the school district board of trustees to publicly post the reasons the candidate meets the current district needs regarding the position of superintendent. The statutory authority for 19 TAC §242.20 is the Texas Education Code (TEC), §§21.003(a), 21.040(4), 21.041(b)(2)-(4), and 21.046(a).

5. Proposed Revisions to 19 TAC Chapter 66, State Adoption and Distribution of Instructional Materials, Subchapter A, General Provisions, Subchapter B, State Adoption of Instructional Materials, and Subchapter C, Local Operations

This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 66, State Adoption and Distribution of Instructional Materials, Subchapter A, General Provisions, Subchapter B, State Adoption of Instructional Materials, and Subchapter C, Local Operations. The proposed revisions would update rules related to state review and adoption of instructional materials as well as ordering and distribution of instructional materials. Statutory authority for this action is the Texas Education Code (TEC), §§7.102, 31.003, 31.022, 31.0221, 31.023, 31.024, 31.0241, 31.026, 31.0261, and 31.035.

6. Proposed Amendments to 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements

This item presents for first reading and filing authorization proposed amendments to 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements, to update the rules and to align with recent legislative changes. Statutory authority for this action is the Texas Education Code (TEC), §7.102(c)(4) and §28.025(a), (b-1)-(b-3), (b-12), (b-13), (b-19), (c-1)-(c-3), (c-5), and (e-1).

7. Proposed New 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter C, High School, §113.49, Personal Financial Literacy (One-Half Credit), Adopted 2016

This item presents for first reading and filing authorization proposed new 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter C, High School, §113.49, Personal Financial Literacy (One-Half Credit), Adopted 2016. The proposal would add Texas Essential Knowledge and Skills (TEKS) for a new personal financial literacy one-half credit elective course. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, 28.0021, and 28.025.

8. Proposed New 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, §74.6, College and Career Readiness and Texas Essential Knowledge and Skills Alignment

This item presents for first reading and filing authorization proposed new 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, §74.6, College and Career Readiness and Texas Essential Knowledge and Skills Alignment. The proposal would adopt charts indicating the alignment of the College and Career Readiness Standards (CCRS) and the Texas Essential Knowledge and Skills (TEKS), as required by House Bill (HB) 1613, 84th Texas Legislature, Regular Session, 2015. Statutory authority for this action is the Texas Education Code (TEC), §28.008, as amended by HB 1613, 84th Texas Legislature, Regular Session, 2015.

9. Review of Proposed Amendments to 19 TAC Chapter 244, Certificate of Completion of Training for Appraisers, §244.1, General Provisions, and §244.2, Training for Appraisers of Educators in School Districts Using a Recommended Appraisal Process

This item provides the State Board of Education (SBOE) an opportunity to review the State Board for Educator Certification (SBEC) rule actions that would amend 19 TAC Chapter 244, Certificate of Completion of Training for Appraisers, §244.1, General Provisions, and §244.2, Training for Appraisers of Educators in School Districts Using a Recommended Appraisal Process. The proposed amendments to 19 TAC §244.1 and §244.2 would replace references to the old state-recommended teacher appraisal system, the Professional Development and Appraisal System (PDAS), with references to the state-recommended teacher appraisal system and would add language to include training for appraisers of principals using the state-recommended principal appraisal system. The statutory authority for 19 TAC §244.1 and §244.2 is the Texas Education Code, §21.041(b)(10).

10. Adoption of Review of 19 TAC Chapter 157, Hearings and Appeals, Subchapter A, General Provisions for Hearings Before the State Board of Education, and Subchapter D, Independent Hearing Examiners
(Adoption of Review)
 

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. This item presents the adoption of the review of 19 TAC Chapter 157, Hearings and Appeals, Subchapter A, General Provisions for Hearings Before the State Board of Education, and Subchapter D, Independent Hearing Examiners. Subchapter A establishes the procedures for appeals heard by the SBOE regarding administrative penalties for violations of textbook requirements. Subchapter D sets forth the certification criteria for independent hearing examiners who conduct due process termination, nonrenewal, and suspension without pay hearings at the school district level. The statutory authority for the rule review is the Texas Government Code, §2001.039. The statutory authority for 19 TAC Chapter 157, Subchapter A, is the Texas Education Code (TEC), §31.151, and the Texas Government Code, §2001.004. The statutory authority for Subchapter D is the TEC, §21.252.

This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2013 through August 2017. Texas Government Code, §2001.039, requires an ongoing four-year rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting or readopting a rule continues to exist.
