Proposed Revisions to 19 TAC Chapter 110, Texas Essential Knowledge and Skills
for English Language Arts and Reading, and Chapter 111, Texas Essential Knowledge
and Skills for Mathematics

SUMMARY: This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 110, Texas Essential Knowledge and Skills for English Language Arts and Reading, Subchapter D, Other High School English Language Arts and Reading Courses, and Chapter 111, Texas Essential Knowledge and Skills for Mathematics, Subchapter D, Other High School Mathematics Courses. The proposed revisions would update the amount of credit available for Advanced Placement (AP) English language arts and reading and mathematics courses and remove rules that are outdated and duplicative of other State Board of Education (SBOE) rules.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4); 28.002; and 28.025, as amended by House Bill (HB) 3593 and Senate Bill (SB) 826, 85th Texas Legislature, Regular Session, 2017.

TEC, §7.102(c)(4), requires the SBOE to establish curriculum and graduation requirements.

TEC, §28.002, identifies the subjects of the required curriculum and requires the SBOE by rule to identify the essential knowledge and skills of each subject in the required curriculum that all students should be able to demonstrate and that will be used in evaluating instructional materials and addressed on the state assessment instruments.

TEC, §28.025, as amended by HB 3593 and SB 826, 85th Texas Legislature, Regular Session, 2017, requires the SBOE by rule to determine the curriculum requirements for the foundation high school graduation program that are consistent with the required curriculum under the TEC, §28.002.

EFFECTIVE DATE: The proposed effective date of the proposed revisions is August 27, 2018.

PREVIOUS BOARD ACTION: The SBOE originally adopted the Texas Essential Knowledge and Skills (TEKS) for AP courses in English language arts and reading and mathematics effective September 1, 1998. The SBOE adopted new 19 TAC §111.61, Other Courses for Which Students May Receive Mathematics Credit, effective July 12, 2010. At the November 2017 meeting, the SBOE approved proposed revisions to 19 TAC Chapter 110, Subchapter D; Chapter 111, Subchapter D; Chapter 112, Subchapter D; and Chapter 114, Subchapter D, concerning International Baccalaureate courses, as amended, for first reading and filing authorization.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: Rules in 19 TAC Chapter 110, Subchapter D, identify the requirements for high school English language arts and reading AP and International Baccalaureate (IB) courses. The rules also include requirements for independent study courses for which a student may receive English language arts and reading credit. Rules in 19 TAC Chapter 111, Subchapter D, identify the requirements for high school AP and IB courses and for career and technical education (CTE) courses eligible for mathematics credit.

The CTE TEKS are included in 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education. In 2015, the SBOE approved new CTE TEKS, which were implemented beginning in the 2017-2018 school year. The new CTE TEKS that the SBOE approved for mathematics credit include revised course titles and section numbers. These outdated CTE courses are currently cross referenced in 19 TAC §111.61; therefore, the titles and/or section numbers for the courses are no longer aligned.

The proposed revisions would modify the amount of credit that could be earned for AP courses in English language arts and reading and mathematics to eliminate the range of credits. The section titles would be updated to indicate the change in credit.

The proposed revisions would eliminate §110.82, relating to independent study in English, journalism, and/or speech, to remove rules that are duplicative and reduce confusion. Additionally, the proposed revisions would eliminate §111.61, relating to CTE course for which students may receive mathematics credit, to remove rules that are outdated and no longer aligned with other SBOE rules.

Attachments II and III reflect the text of proposed revisions to 19 TAC Chapter 110, Subchapter D, and Chapter 111, Subchapter D. These proposed revisions were not presented as a discussion item; however, the SBOE may consider this item for first reading and filing authorization as authorized under its operating procedures. It is recommended the SBOE consider this item for first reading and filing authorization to coordinate these revisions with the revisions to other SBOE rules relating to AP and IB courses.

FISCAL IMPACT: The Texas Education Agency (TEA) has determined that there are no additional costs to persons or entities required to comply with the proposed revisions. In addition, there is no direct adverse economic impact for small businesses, microbusinesses, or rural communities; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required. There is no effect on local economy for the first five years that the proposed revisions are in effect; therefore, no local employment impact statement is required under Texas Government Code, §2001.022. The proposed revisions do not impose a cost on regulated persons and, therefore, are not subject to Texas Government Code, §2001.0045.

GOVERNMENT GROWTH IMPACT: TEA staff has determined that the proposed revisions do not have a government growth impact pursuant to Texas Government Code, §2001.0221.

PUBLIC AND STUDENT BENEFIT: Benefits include consistency in TEKS-based AP course credit and the elimination of language that is outdated or duplicative to prevent confusion for administrators and teachers.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed revisions would have no new procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed revisions would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: The public comment period will begin when the proposal, approved for first reading and filing authorization, is published in the Texas Register.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: A request for a public hearing on the proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

MOTIONS TO BE CONSIDERED: The State Board of Education:

Suspend the board operating procedures in accordance with §5.2(a) to allow consideration at first reading and filing authorization; and

Approve for first reading and filing authorization proposed revisions to 19 TAC Chapter 110, Texas Essential Knowledge and Skills for English Language Arts and Reading, and Chapter 111, Texas Essential Knowledge and Skills for Mathematics.
