3. Approval of Proclamation 2020 Questions and Answers


Proclamation 2020, issued by the State Board of Education (SBOE) in April 2018, calls for instructional materials for courses in high school English language arts and reading; English Learners Language Arts, grades 7 and 8; English I and II for Speakers of Other Languages; English Language Development and Acquisition (ELDA); Reading I, II, III; College Readiness and Study Skills; Visual Media Analysis and Production; Contemporary Media; Literary Genres; Creative Writing; Research and Technical Writing; Practical Writing Skills; Humanities; Public Speaking I, II, III; Communication Applications; Oral Interpretation I, II, III; Debate I, II, III; Journalism; Advanced Broadcast Journalism I, II, III; Photojournalism; and Advanced Journalism: Yearbook I, II, III/Newspaper I, II, III/Literary Magazine. Publishers and other stakeholders were given an opportunity to ask questions at a Proclamation 2020 introduction meeting held in March 2018 and encouraged to submit additional questions through email. The resulting question and answer document for Proclamation 2020 is to be presented for board approval. Statutory authority is the Texas Education Code (TEC), §31.022.

4. Texas Certificate of High School Equivalency

This item provides an opportunity for the board to consider a proposed increase in Educational Testing Service’s (ETS) fee for the paper-based High School Equivalency Test (HiSET). Statutory authority is Texas Education Code (TEC), §7.111.

5. Proposed New 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.39, Requirements for Instruction on Proper Interaction with Peace Officers

This item presents for second reading and final adoption proposed new 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.39, Requirements for Instruction on Proper Interaction with Peace Officers, to implement Senate Bill (SB) 30, 85th Texas Legislature, Regular Session, 2017, regarding required instruction on proper interaction with peace officers. No changes are recommended since approved for first reading. Statutory authority is the Texas Education Code (TEC), §§7.102(c)(4); 28.012, as added by Senate Bill (SB) 30, 85th Texas Legislature, Regular Session, 2017; and 28.025(b-20), as added by SB 30, 85th Texas Legislature, Regular Session, 2017.

6. Proposed New 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter C, High School, §113.50, Ethnic Studies: An Overview of Americans of Mexican Descent (One Credit)

This item presents for first reading and filing authorization proposed new 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter C, High School, §113.50, Ethnic Studies: An Overview of Americans of Mexican Descent (One Credit). The proposal would add Texas Essential Knowledge and Skills (TEKS) for a new high school social studies course for implementation in the 2019-2020 school year. Statutory authority is Texas Education Code (TEC), §§7.102(c)(4) and 28.002.

7. Proposed Amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.24, Credit by Examination

This item presents for second reading and final adoption proposed amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.24, Credit by Examination, to amend the provisions related to test development and validation. No changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(12), 28.0023, as amended by House Bill (SB) 789, 85th Texas Legislature, Regular Session, 2017.

8. Proposed Amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.28, Students with Dyslexia and Related Disorders

This item presents for second reading and final adoption proposed amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.28, Students with Dyslexia and Related Disorders, to update the rule and to align the rule with recent legislative changes made by House Bill (HB) 1886, 85th Texas Legislature, Regular Session, 2017. No changes are recommended since approved for first reading. Statutory authority for this action is the Texas Education Code (TEC), §7.102(c)(28) and §38.003, as amended by House Bill (HB) 1886, 85th Texas Legislature, Regular Session, 2017.

9. Proposed Repeal of 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter D, Other Social Studies Courses, §113.69, Other Courses for which Students May Receive Social Studies Credit, and §113.70, Concurrent Enrollment in College Courses
(First Reading and Filing Authorization)


This item presents for first reading and filing authorization proposed repeal of 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter D, Other Social Studies Courses, §113.69, Other Courses for which Students May Receive Social Studies Credit, and §113.70, Concurrent Enrollment in College Courses. The proposal would repeal rules that are outdated and no longer necessary. Statutory authority is Texas Education Code (TEC), §§7.102(c)(4); 28.002; and 28.025.

10. Activities Related to a Student Art Competition to Develop a Permanent School Fund Logo


This item provides the opportunity for the committee and board to consider activities related to a student art competition to create a Permanent School Fund logo. Statutory authority for this action is the Texas Constitution Article VII, §5(f) and the Texas Education Code (TEC), §7.102(c)(3).

11. Review of the Commissioner of Education’s Generation 23 Charter Proposals


This item provides the committee and board an opportunity to review and take action or no action on the commissioner’s list of proposed Subchapter D Open-Enrollment Charter Schools scheduled to open in school year 2019-2020. If awarded, the charters will have an initial five-year term with a July 31, 2024 contract end date. The statutory authority is Texas Education Code (TEC), §12.101.

12. Development of a Long-Range Plan for Public Education

This item provides the committee and board with the opportunity to consider vision statements and recommendations proposed by the Long-Range Plan for Public Education Steering Committee. Statutory authority is the Texas Education Code (TEC), §7.102(c)(1).

2. Current Status of the Permanent School Fund

3. 2017-2021 Rule Review Plan for State Board of Education Rules


This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2017 through August 2021. Texas Government Code, §2001.039, requires an ongoing four-year rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting or readopting a rule continues to exist.

4. Notice of Intent to Amend the Financial Accountability System Resources Guide

This item provides notice of intent to amend the Financial Accountability System Resource Guide. In accordance with 19 TAC §109.41, the commissioner of education shall amend the Financial Accountability System Resource Guide, as needed, adopting it by reference per 19 TAC Chapter 109, Budgeting, Accounting, and Auditing, Subchapter C, Adoptions by Reference. The amendment being proposed includes updates to modules and to remove obsolete references. Specifically, modules: 1 – Financial Accounting and Reporting, 4 – Auditing, 10 – Special Supplement – Charter Schools, and 11 – Special Supplement – Non-profit Charter School Chart of Accounts; and repeal of modules: 2 – Budgeting, 5 – Site Based Decision-Making, 6 – Accountability, 7 – Data Collection and Reporting, and 8 – Management. The effective date of the proposed amendment will be 20 days after filing as adopted with the Texas Register.

5. Review of Annual Audit Plan of the Division of Financial Compliance for 2018-2019 School Year

This item covers the annual audit plan of the Division of Financial Compliance for the 2018-2019 school year for field and independent financial reviews as specifically described in 19 TAC Chapter 109, Texas Education Agency Audit Functions, §109.21, Annual Audit Plan.
