The State Board for Educator Certification will elect a Chairperson, Vice-Chairperson, and Secretary during a special election as the result of recent board member vacancies.

4. State Board for Educator Certification Welcome New Board Members and Recognition of Former Board Members

This item provides the State Board for Educator Certification (SBEC) an opportunity to welcome new board members and recognize former board members for their service to Texas schoolchildren and educators.

5. Public Comment

The Board shall allocate up to thirty (30) minutes at the beginning of each regularly scheduled meeting of the full Board for public comment on non-agenda and consent agenda items. In accordance with SBEC Board Operating Policies and Procedures, late registration for providing oral or written comment will be accepted up to 30 minutes prior to the beginning of the Board meeting.

7. Adoption of Review of 19 TAC Chapter 227, Provisions for Educator Preparation Candidates

Texas Government Code (TGC), §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board for Educator Certification (SBEC) rules. This item presents for SBEC approval the adoption of review of 19 Texas Administrative Code (TAC) 227, Provisions for Educator Preparation Candidates. The rules being reviewed provide requirements for admission to educator preparation programs (EPPs) and preliminary evaluation of certification eligibility.

8. Adoption of Review of 19 TAC Chapter 228, Requirements for Educator Preparation Programs

Texas Government Code (TGC), §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board for Educator Certification (SBEC) rules. This item presents for SBEC approval the adoption of review of 19 Texas Administrative Code (TAC) Chapter 228, Requirements for Educator Preparation Programs. The rules being reviewed provide requirements relating to educator preparation programs (EPPs).

9. Proposed Amendments to 19 TAC Chapter 229, Accountability System for Educator Preparation Programs

This item provides the State Board for Educator Certification (SBEC) an opportunity to discuss and propose amendments to 19 Texas Administrative Code (TAC) Chapter 229, Accountability System for Educator Preparation Programs. Chapter 229 establishes the performance standards and procedures for educator preparation program (EPP) accountability. The proposed amendments would provide for adjustments to the 2020–2021 Accountability System for Educator Preparation (ASEP) Manual due to the ongoing public health situation; implement House Bill (HB) 159, 87th Texas Legislature, 2021, to add students with disabilities to the student achievement ASEP performance indicator regarding student performance; provide additional clarity for certificate category calculations; and provide updates to the ASEP Manual.

10. Request to Approve New Educator Preparation Program at Odessa Pathway to Teaching (OPT) at Ector County ISD

This item provides the State Board for Educator Certification (SBEC) an opportunity to approve a request by Odessa Pathway to Teaching, located in Odessa, Texas to be approved as an educator preparation program (EPP) through the alternative certification route. Texas Education Agency (TEA) staff reviewed the proposal and found that it complied with provisions of 19 TAC Chapter 227, Provisions for Educator Preparation Candidates, Chapter 228, Requirements for Educator Preparation Programs, Chapter 229, Accountability System for Educator Preparation Programs, and Chapter 230, Professional Educator Preparation and Certification, Subchapter B, General Certification Requirements.

11. Appointment of Committee Chair and Members to the SBEC EPP Commendations Committee

This item provides the State Board for Educator Certification (SBEC) Chair an opportunity to appoint a committee chair and members to the SBEC Educator Preparation Program (EPP) Commendations Committee. The Board committee recommends high-performing EPPs to the full Board for commendations.

13. Discussion of Proposed Amendments to 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter B, Enforcement Actions and Guidelines, and Subchapter E, Post-Hearing Matters

This item provides the State Board for Educator Certification (“SBEC” or “the Board”) an opportunity to discuss proposed amendments to 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter B, Enforcement Actions and Guidelines, and Subchapter E, Post-Hearing Matters. The proposed amendments would implement House Bill 2519, 87th Texas Legislature, Regular Session by amending the Board’s rules to allow the Board to put conditions on a certificate without any additional sanctions, to reduce the minimum sanction for contract abandonment that occurs 30 days or more from the first day of instruction for the next school year, and to clarify the notice that TEA sends sanctioned educators along with their final orders regarding the necessity of filing a motion for rehearing if the respondent wants to appeal the decision.

14. Discussion of Texas Certification Options for Individuals Certified Outside the State

This item provides the State Board for Educator Certification (SBEC) the opportunity to discuss the process and options for individuals certified outside the state to receive Texas educator certification.
