7. Consider and Take Appropriate Action on Passing Standards for Agriculture, Food, and Natural Resources, 6-12; Business and Finance, 6-12; Health Science, 6-12; and Marketing, 6-12 (PDF 60KB)

This item provides the State Board for Educator Certification (SBEC) the opportunity to review and approve passing standards for four new Texas Examinations of Educator Standards (TExES): Agriculture, Food, and Natural Resources, 6-12; Business and Finance, 6-12; Health Science, 6-12; and Marketing, 6-12. These passing standards will allow test results to be calculated and reported to candidates taking these examinations during the 2015-2016 administration year and subsequent administrations. Candidates in preparation programs and educators pursuing a new area need to demonstrate content mastery in particular subject areas in order to qualify for their certificates. This item requests consideration for the SBEC to review and approve a new passing standard for the examinations as recommended by the standard-setting committees of educators.

Consider and Take Appropriate Action on Adoption of Proposed Amendments to 19 TAC Chapter 229, Accountability System for Educator Preparation Programs, §229.9, Fees for Educator Preparation Program Approval and Accountability; and Chapter 230, Professional Educator Preparation and Certification, Subchapter G, Certificate Issuance Procedures, §230.101, Schedule of Fees for Certification Services, and §230.103, E-Pay Supplemental Fee (PDF 66KB)

This item provides the State Board for Educator Certification (SBEC) an opportunity to adopt, subject to State Board of Education (SBOE) review, proposed amendments to 19 TAC Chapter 229, Accountability System for Educator Preparation Programs, §229.9, Fees for Educator Preparation Program Approval and Accountability, and Chapter 230, Professional Educator Preparation and Certification, Subchapter G, Certificate Issuance Procedures, §230.101, Schedule of Fees for Certification Services, and §230.103, E-Pay Supplemental Fee. As part of its report to the 83rd Texas Legislature, Regular Session, 2013, the Sunset Advisory Commission recommended a management action that fees in rule for educator certification and educator preparation programs (EPPs) be evaluated and adjusted to cover costs and ensure equity. The proposed amendments to 19 TAC §§229.9, 230.101, and 230.103 would adjust certain fees to more adequately cover costs and increase the equity of fees across different types of fee payers. No changes are recommended since published as proposed.

9. Consider and Take Appropriate Action on Adoption of Proposed Amendments to 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases (PDF 155KB) 

This item provides the State Board for Educator Certification (SBEC) an opportunity to adopt, subject to State Board of Education (SBOE) review, proposed amendments to 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases. The proposed amendments would modify the certified educator discipline process to clarify that the SBEC has final approval of each settlement by voting on agreed orders and that the SBEC may sanction an educator for a violation of the Texas Education Code (TEC), §22.085. The proposed amendments would also modernize and clarify the description of the procedures SBEC follows for final orders. No changes are recommended since published as proposed.

10. Consider and Take Appropriate Action on Adoption of Review of 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases (PDF 296KB)  

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board for Educator Certification (SBEC) rules. This item presents for SBEC approval the adoption of the review of 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases. The rules being reviewed provide procedures and requirements relating to general provisions, enforcement actions and guidelines, prehearing matters, hearing procedures, and post-hearing matters.

11. Consider and Take Appropriate Action on Proposed Revisions to 19 TAC Chapter 227, Provisions for Educator Preparation Candidates (PDF 86KB)

Texas Education Code (TEC), §21.042, requires the State Board for Educator Certification (SBEC) to submit a written copy of each rule it proposes to adopt to the State Board of Education (SBOE) for review. At its September 2014 meeting, the SBOE reviewed and rejected the proposed revisions to 19 TAC Chapter 227, Provisions for Educator Preparation Candidates. At its October 2014 meeting, the SBEC requested that this item be added to the March 2015 agenda for discussion and possible action. At its March 2015 meeting, the SBEC postponed taking action and requested that this item be added to the June 2015 agenda for discussion and possible action. As part of this item, Texas Education Agency (TEA) staff will provide an update and status to allow the SBEC to consider whether to propose amendments to the rules.

12. Consider and Take Appropriate Action on Proposed Revisions to 19 TAC Chapter 231, Requirements for Public School Personnel Assignments, Subchapter C, Grades 6-8 Assignments and Subchapter E, Grades 9-12 Assignments (PDF 92KB)

This item provides the State Board for Educator Certification (SBEC) an opportunity to discuss and propose revisions to 19 TAC Chapter 231, Requirements for Public School Personnel Assignments, Subchapter C, Grades 6-8 Assignments, and Subchapter E, Grades 9-12 Assignments. The proposed amendments to 19 TAC §§231.49, 231.65, 231.71, 231.73, 231.75, 231.77, 231.211, 231.213, 231.241, 231.573, and 231.591 and proposed new 19 TAC §§231.81, 231.193, 231.195, 231.395, 231.579, and 231.581 would clarify the appropriate credential for placement in a particular teaching assignment.

13. Consider and Take Appropriate Action on Proposed Review of 19 TAC Chapter 233, Categories of Classroom Teaching Certificates (PDF 136KB)  

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board for Educator Certification (SBEC) rules. This item presents for SBEC approval the proposed review of 19 TAC Chapter 233, Categories of Classroom Teaching Certificates. The rules being reviewed establish the certificate categories within the certificate classes for classroom teachers.

14. Consider and Take Appropriate Action on Proposed Review of 19 TAC Chapter 244, Certificate of Completion of Training for Appraisers (PDF 37KB)

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board for Educator Certification (SBEC) rules. This item presents for SBEC approval the proposed review of 19 TAC Chapter 244, Certificate of Completion of Training for Appraisers. The rules being reviewed provide requirements for ensuring the certification of appraisers performing appraisals of teachers, administrators, and counselors employed in Texas public schools.

15. Consider and Take Appropriate Action on Request to Change Wiley College’s 2012-2013 Accountability System for Educator Preparation Programs (ASEP) Accreditation Status (PDF 25KB)

This item provides the State Board for Educator Certification (SBEC) the opportunity to approve a revised 2012-2013 Accountability System for Educator Preparation Programs (ASEP) Accreditation Status for Wiley College.

16. Consider and Take Appropriate Action on Request to Approve the 2013-2014 Accountability System for Educator Preparation Programs (ASEP) Accreditation Statuses (PDF 518KB)

This item provides the State Board for Educator Certification (SBEC) the opportunity to approve the proposed 2013-2014 Accountability System for Educator Preparation Programs (ASEP) Accreditation Statuses for one hundred forty-nine (149) educator preparation programs (EPP). One hundred and forty-one (141) programs are recommended to be rated as “Accredited,” four (4) programs as “Accredited – Not Rated,” three (3) programs as “Accredited-Warned,” and one (1) program as “Accredited – Probation.” Twenty-one (21) programs will be required to develop an action plan to address deficiencies in aggregated and disaggregated group performance. Sixty-nine (69) programs will be provided with a notice regarding one or more certification field performance issues.

17. Consider and Take Appropriate Action on Request for State Board for Educator Certification (SBEC) Action Related to TeacherBuilder.com, an Educator Preparation Program (PDF 50KB)

This item provides the State Board for Educator Certification (SBEC) an opportunity to consider a proposed Texas Education Agency (TEA) staff recommendation that the SBEC take action to impose conditions on the continuing approval of TeacherBuilder.com to provide educator preparation.
