House Bill 3, as passed by the 86th Legislature, was signed into law by Governor Abbott on June 11, 2019. HB 3 impacts school districts serving gifted/talented (G/T) students. 

The G/T program requirements for school districts under HB3 are:

  1. Each district shall adopt a policy regarding the use of funds to support the district’s program for G/T students. 
  2. Each district shall annually certify to the commissioner that the district has established a program for G/T students as required by rule and it is consistent with the Texas State Plan for the Education of Gifted/Talented Students (State Plan) under Texas Education Code Section 29.123.
  3. Each district shall report to the commissioner regarding the use of the funds on the district’s program for G/T as provided by State Board of Education rule. 

TEA and the Texas Association of Schools Boards (TASB) has worked together on the language for the G/T use of funds policy. The update to EHBB (Gifted/Talented policy code) will be in TASB’s Update 114 in November 2019.
The G/T allotment was reallocated to the Basic Allotment to allow for the efficient disbursement of funding to schools. The reallocation will also lift the arbitrary cap on the number of students that districts identify and serve as G/T in the expectation of receiving funding.  Please review the G/T Estimated Funding Allocations for your district’s allocated funding amount for G/T services posted on the HB 3 website.  

Annual Certification

For the 2019-2021 school years, school districts shall:

  1. appropriately code districts’ defined G/T programs at each grade level; and 
  2. report the use of the G/T funds regarding districts’ programs for G/T students using Program Intent Code 21.

The agency will develop an effective implementation tool for the certification of consistency with the State Plan.
